PATRIOT LETTER: ZUNDEL SUPPORT IN THE WORKS — ALL YOURS

Patriot Letter. Dated 3/3/05.

Archived by k0nsl.

Dear Fellow Patriot!

Boy, did I feel great today when I saw the awesome
response from our German colleagues to my request to
help and care for Ernst Zundel in Germany. Zundel
already arrived in Mannheim Prison in Germany, a
familiar “guesthouse” for many revisionists. Dr.
Fredrick Toben was once a “guest” there.

Let me make clear that our activities are independent
of whatever Ernst Zundel’s wife is doing. Zundel is
now in Germany and it is a whole different ballgame.

It is my advise to you that you wait with any “gift”
until we have a person in Germany that can manage it.
I personally also suggest, in order to eliminate the
middle man, do not give anything to the Zundel crew in
Canada. German law is different from the U.S. and
Canada and U.S. attorneys as well as Canadian
attorneys mean nothing to German authorities.

I suggest also you wait for Ernst’s wife to give you
directions.

Here in the Community News war room, we’ll do what we
have to do. I was quite proud to be of German heritage
when I saw the immediate action of German activists on
behalf of Ernst Zundel.

Horst Mahler, who faces prison time himself, e-mail
quick that he will help in any way he can:

Sehr geehrter Herr Mueller!

Of course, the mover and shaker is Guenther Deckert.
Within hours of my e-mail he contacted Ernst’s wife,
has already offered legal advice and forwarded me the
first reports of Ernst’s arrival and the District
Attorney’s office. Guenther Deckert is an invaluable
asset in helping Zundel, since he knows the prison
system in and out, having spent five years in it. Mr.
Deckert agrees with me that German prisons are far
more humane than the ones in Canada and even in the
U.S.

I am grateful that Mr. Deckert in great part does his
own translations, however, for the rest I will
translate for now. But remember, my translations are
rough and “Mueller” style until we find a volunteer.

I am hoping we can convince Guenther Deckert to be the
base for the Zundel support and maybe open an account
so we can send donations directly to him. All
information I will pass on to Dr. Fredrick Toben, to
post on his website, since he is the only one that
keeps his site up to date and current. Already, he
posted the pictures of Mannheim Prison, where Ernst
Zundel currently is. So, I recommend that you check
the Adelaide Institute’s website often:

http://www.adelaideinstitute.org

Again, Community News isn’t seeking agreements or
permissions from Ernst Zundel’s wife. Our priority is
Ernst Zundel and his well-being in Germany. I cannot
tell you how relieved I am that most of my pleads for
help came through. Maybe Manfred Roeder will become a
prison companion to Ernst Zundel, and solitary
confinement will be a thing of the past. Once we have
established a base (Guenther Deckert?), several of my
friends and relatives will do some fundraising, so
Ernst will have some money. Now let’s herar from
Guenther Deckert:

I was phoned some minutes ago that E. is said to have
arrived here (? Frankfurt Airport) to be transferred
to Mannheim State prison about 12miles/20km from where
I live.
I have realized that I do NOT have the e-mail address
of Ernst´s wife Ingrid. — Please, will you inform
her as quickly as you can:
1) A friend will contact Mannheim Prison tomorrow
morning to inquire if Ernst was transferred there.
2) We will find out the ways when and how to visit
him, depending on which institution will be
responsible for him – prosecutor´s office or prison
authorities.
3) We will see, together with Ernst´sister that he
will be well looked after.
4) Tell her that she SHOIUD NOT, at this stage, ask
lawyers etc. to intervene which only means, money,
money…. Ernst himself can and must inquire why he is
imprisoned. They must give him the reason(s). And only
then a lawyer should be told to check the
“accusation”, NOT more. – If there is an accusation
based on the famous German § 130, even the best and
therefore very expensive lawyers can do NOTHING for
him. He will depend on the court!!!
It will depend on Enrst´ s personal strategy to stand
a full § 130 trial with an outcome of a five-year
prison term, or ……

Frau Rimland should contact me via e-mail as soon as
possible. She may even phone me if she thinks it
necessary.

Best wishes

Dear Everybody,
Based on today´s news Ernst was taken from Frankfurt
Airport direchtly to Mannheim Prison due to a
“warrant” going back to 2003 because of website
texts…

J. Rieger is too far away: Hamburg. As to him checking
the possible accusation against Ernst, there is NO
problem, as it can be done by mail.
If there should be what we call in German
“Haftprüfungstermin”, i.e. a hearing where one judge
will rule if the arrestation is to continue, a lawyer
might be of some help, but is NOT necessary, as Ernst,
whose German is still good, and who´s got enough
experience, in my mind, does not need one.
What must be done is that Ernst is well looked after –
… daß Ernst sehr gut betreut wird. – If Frau Zündel
wishes so, I can organize a circle of persons, based
in our area, which is “Greater Mannheim” – 50km around
Mannheim -, willing to look after Ernst and go to see
him as often he will be allowed to und provide him
with everything that is permitted. – Fredrick T. can
tell Frau Zündel what Mannheim is like; so can I The
living conditions there are not as bad as they might
have been in Ontario..

As to me I am quite fine though we all grow older – I
was 65 in January. – For the time being, apart from my
political activities (NPD), I have been translating
Irving´s revised millenium edition “Hitler´s War and
the Warpath”, about 900 (!) pages for some weeks.
After that I will do the proof reading of a book of a
Norwegian SS-Volunteer (Wiking/Viking). This finished
I will attack the revised edition of Irving´s
“Destruction of Dresden”.

That´s it for today.

Best wishes

Greetings to Everbody,

The judge sitting alone ruled roday that Ernst has to
stay in prison! The accusation will deal with internet
texts conderning “St. Holo..” etc – all the stuff
familiar to you.
His actual “residence” is:

Ernst Zündel (JVA) ***
Herzogenriedstr. 111
D 68169 Mannheim

The address of the prosecutor´s office runs as
follows:

Staatsanwaltschaft (StA)
L4, 15
D 68149 Mannheim
– phone/fax: …… 621 – 292 7106
621 – 292 7130

Newspapers: 1) Mannheimer Morgen, 2) Rheinpfalz, 3)
Rhein-Neckar-Zeitung – exact addresses will follow
tomorrow.

Insight hints of Mannheim Prison (JVA) possible by Dr.
Frederick Töben who stayed there a couple of months as
well as by me, Günter Deckert who stayed there as
well, but much less than Dr. T. did; I spent most of
my five years at “Veste Bruchsal” as some among you
will well remember.

Günter Deckert

*** “JVA” standing for “Justizvollzugsanstalt”

Mannheim, about 350.000 inhabitants ist situated on
either side of the Neckar and on the right side of the
Rhine (opposite of Ludwigshafen – BASF); the Neckar
mouthes in the Rhine there.
The city “houses” about 60.000 foreigners most of them
Turcs having a mosque of their own for some years
already.
Heidelberg is 20km to the east, Frankfurt (Airport)
about 75km to the north, Karlsruhe about 75km to the
south, and Stuttgart, on the Neckar as well, with
airport, is about 12okm to the south-east.
Weinheim, where I have got my home, is about 2okm to
the east. – The area is part of the old “Palatinate”
(Heidelberg Castle, Mannheim Castle, Schwestzingen /
summer residence of the “prince electors of
Palatinate”  who had the right to choose the German
emperor in the Middle Ages. Not far away are: 1) Worms
(Nibelungen) and ancient dome of Romanic style as well
as 2) Speyer with ancient dome of Romanic style where
some of the German emperors of the Middle Ages are
buried; the two of them are as well situated on the
Rhine, and are about 30km to the north (Worms) and
30km to the south (Speyer).

Ernst´s home area (northern part of the Black Forest)
ist not too far away: about 100 km.

I hope that you may have got some impression of the
area Ernst will have to stay in for some time.

Sincerely

Guenter (Deckert)

Thank you for getting the ball rolling to assist Ernst
Zundel. Once others know how to contribute I am sure
they will want to follow………..but it’s the
leadership that makes the difference.  Once again
you’ve have proven you’ve got the know-how and the
guts to actually do something instead of whining about
everything.

At first I wondered why you’d even publish Margaret
Wente’s remarks then decided it was actually best that
the world be allowed to read, from her own words, what
a moron she actually is.

they grasp the complexities of life as such.

HE SPEAKS

On Aryan Unity

“And again the National Socialist movement has the
mightiest task to fulfill:  It must open the eyes of
the people concerning foreign nations, and must remind
them again and again of the true enemy of our
present-day world.  In place of hatred against
Aryans—from whom almost everything may separate us,
but with whom we are nevertheless bound by common
blood or the great line of a kindred culture—it must
call universal wrath upon the foul enemy of mankind as
the real originator
of our suffering.

“It must make sure that in our country, at least, the
most deadly enemy is recognized and that the fight
against him becomes a gleaming symbol of a brighter
time, to show other nations the way to the salvation
of an embattled Aryan mankind.”

ACLU and Human Rights First Sue Defense Secretary
Rumsfeld Over U.S. Torture Policies
More on Ending Torture

WASHINGTON — Defense Secretary Donald Rumsfeld bears
direct responsibility for the torture and abuse of
detainees in U.S. military custody, the American Civil
Liberties Union and Human Rights First charged today
in the first federal court lawsuit to name a top U.S.
official in the ongoing torture scandal in Iraq and
Afghanistan that has tarnished America’s reputation.

The lawsuit was filed in federal court in Illinois on
behalf of eight men who were subject to torture and
abuse at the hands of U.S. forces under Secretary
Rumsfeld’s command. The parties are seeking a court
order declaring that Secretary Rumsfeld’s actions
violated the U.S. Constitution, federal statutes and
international law.

“Secretary Rumsfeld bears direct and ultimate
responsibility for this descent into horror by
personally authorizing unlawful interrogation
techniques and by abdicating his legal duty to stop
torture,” said Lucas Guttentag, lead counsel in the
lawsuit and director of the ACLU’s Immigrants’ Rights
Project. “He gives lip service to being responsible
but has not been held accountable for his actions.
This lawsuit puts the blame where it belongs, on the
Secretary of Defense.”

The groups are joined as co-counsel in the lawsuit by
Rear Admiral John D. Hutson (Ret. USN), former Judge
Advocate General of the Navy; Brigadier General James
Cullen (Ret. USA), former Chief Judge (IMA) of the
U.S. Army Court of Criminal Appeals; and Bill Lann
Lee, Chair of the Human Rights Practice Group at
Lieff, Cabraser, Heimann & Bernstein, LLP and former
Assistant Attorney General for Civil Rights at the
Department of Justice. Admiral Hutson and General
Cullen are “of counsel” to Human Rights First.

“Since Abu Ghraib, we have vigorously campaigned for
an independent commission to investigate U.S. policies
that have led to torture and cruel treatment of
detainees. These calls have gone unanswered by the
administration and Congress, and today many of the
illegal polices remain in place,” said Michael Posner,
Executive Director of Human Rights First. “We believed
the United States could correct its policy without
resort to the courts. In bringing this action today,
we reluctantly conclude that we were wrong.”

The men represented in the lawsuit were incarcerated
in U.S. detention facilities in Iraq and Afghanistan,
where they were subjected to torture and other cruel
and degrading treatment, including severe and repeated
beatings, cutting with knives, sexual humiliation and
assault, mock executions, death threats, and restraint
in contorted and excruciating positions. None of the
men were ever charged with a crime. All have been
released.

“One of the greatest strengths of the U.S. military
throughout our history has been strong civilian
leadership at the top of the chain of command,” said
Admiral Hutson. “Unfortunately, Secretary Rumsfeld has
failed to live up to that tradition. In the end, that
imperils our troops and undermines the war effort.

It is critical that we return to another military
tradition: accountability.”

In legal papers, the groups charged Secretary Rumsfeld
with violations of the U.S. Constitution and
international law prohibiting torture and cruel,
inhuman or degrading punishment. The lawsuit also
seeks compensatory damages for the harms suffered as a
result of torture and other abuse.

According to the complaint, Secretary Rumsfeld
“authorized an abandonment of our nation’s inviolable
and deep-rooted prohibition against torture or other
cruel, inhuman or degrading treatment or punishment of
detainees in U.S. military custody.” The complaint
further charges that brutal and illegal interrogation
techniques were personally approved by Secretary
Rumsfeld in December 2002. Those techniques included
the use of “stress positions,” 20-hour interrogations,
the removal of clothing, the use of dogs, isolation,
and sensory deprivation.

Although some of these techniques were later
rescinded, Rumsfeld personally approved a new list in
April 2003, which included dietary manipulation,
sensory deprivation and “false flag” (leading
detainees to believe that they have been transferred
to a country that permits torture). He also made clear
that harsher techniques could be used with his
personal authorization.

“Human rights law and military rules prohibit torture
at all times and in every circumstance, a principle
that applies to the highest commander as well as the
lowest subordinate,” said co-counsel Lee, the former
Justice Department official.

Official government reports have documented many
horrific abuses inflicted on detainees in U.S.
custody. They have shown that the abuse was ongoing
and was not limited to the notorious Abu Ghraib
prison. The ACLU and other advocacy groups have
obtained over 23,000 pages of documents concerning
abuses through a Freedom of Information Act lawsuit,
online at www.aclu.org/torturefoia. As these documents
indicate, the FBI began to complain about the
interrogation techniques used by the military on
detainees in Guantánamo as early as 2002, techniques
that spread to Afghanistan and Iraq. Media reports
have also brought many disturbing incidents to light,
including the deaths of detainees in custody.

The ACLU and Human Rights First have created a
detailed timeline of the various actions that
Secretary Rumsfeld took and the points at which he was
informed of the abuses that resulted, online at
http://www.aclu.org/rumsfeld and
http://www.humanrightsfirst.org/lawsuit.

“The effects of Rumsfeld’s policies have been
devastating both to America’s international reputation
as a beacon of freedom and democracy, and to the
hundreds, even thousands of individuals who have
suffered at the hands of U.S. forces,” said ACLU
Executive Director Anthony D. Romero.

Details about the clients in the case can be found in
the legal complaint and in individual biographical
statements online at http://www.aclu.org/rumsfeld and
http://www.humanrightsfirst.org/lawsuit. Due to safety
and privacy concerns, the individuals named in the
complaint are not currently available for interview.

The ACLU has also filed three similar complaints
against Colonel Thomas Pappas, Brigadier General Janis
Karpinski and Lt. General Ricardo Sanchez on behalf of
the torture victims who were detained in Iraq. These
three additional complaints were filed in federal
courts in Connecticut, South Carolina and Texas,
respectively, due to court requirements regarding
jurisdiction.

The case is Ali et al., v. Rumsfeld, filed in U.S.
District Court in the Northern District of Illinois.
In addition to Guttentag, Adm. Hutson, Gen. Cullen,
Posner and Lee, the attorneys in the case are: Steven
R. Shapiro, Cecillia Wang, Amrit Singh and Omar Jadwat
of the ACLU; Deborah Pearlstein and Fiona Doherty of
Human Rights First; Chimène I. Keitner and Nirej S.
Sekhon of Lieff Cabraser Heimann & Bernstein LLP; Paul
Hoffman of Schonbrun DeSimone Seplow Harris & Hoffman
LLP; Erwin Chemerinsky of Duke University School of
Law; David Rudovsky of Kairys, Rudovsky, Epstein &
Messing LLP; and Harvey Grossman, Legal Director of
the ACLU of Illinois.

All counsel are representing the plaintiffs on a pro
bono basis.
